ODD LITTLE FACTORY / TERMS
Terms of use.
Effective date: 15 October 2026
1. About these terms
These terms set the rules for using Odd Little Factory ("the game"), a mobile game provided by PeakCloud Gameworks sp. z o.o., ul. Ligocka 103/1C, lok. 307, 40-568 Katowice, Poland, entered in the Register of Entrepreneurs of the National Court Register (KRS) under number 0001270291, kept by the District Court Katowice-Wschód in Katowice, 8th Commercial Division; NIP 6343076922, REGON 545852238, share capital PLN 10,000 ("we", "us"). Contact: contact@peakcloudgameworks.com.
By installing or using the game you accept these terms and conclude an agreement with us for the use of the game, supplied electronically. If you don't accept them, please don't use the game. These terms are available at any time, free of charge, on our website and from the game's settings, where you can read, save and print them. A Polish version is available at https://www.peakcloudgameworks.com/games/odd-little-factory/terms/pl/; for consumers in Poland, the Polish version applies.
How we handle personal data is described in our separate Privacy Policy (https://www.peakcloudgameworks.com/games/odd-little-factory/privacy/).
2. Who can play
Everyone may play. If you are a minor, you need the agreement of your parent or legal guardian to use the game and to make any purchase, and they are responsible for how you use it. Parents can use Google Play's parental controls to manage purchases and downloads.
3. What you need
The game runs on Android devices meeting the requirements shown on its Google Play page. It plays offline. An internet connection is needed only to watch optional videos and to make purchases. Your progress is stored only on your device: uninstalling the game or resetting the device deletes it, and we cannot restore it.
4. Your licence
We give you a personal, non-exclusive, non-transferable licence to install and use the game on your own devices for your own entertainment, for as long as you follow these terms. The game, its code, art, sounds, characters and names belong to us or our licensors. You may not:
- copy, sell, rent or distribute the game, or use it commercially;
- decompile or modify it, except where the law expressly allows it;
- cheat, or use tools that alter the game or its data;
- use the game in breach of the law.
5. Virtual items and rewards
The game uses virtual currencies and items, such as Credits and Golden Chips. They are part of the licence in section 4: they are not your property, have no real-world value, and cannot be exchanged for money, transferred or sold.
Optional videos. Some bonuses are earned by choosing to watch a video advert. The reward is granted once, when the video has been watched. A video may not be available at every moment. The adverts come from third-party advertising companies, which are responsible for their content.
We may change the game, including how much items cost or produce, for valid reasons: fixing errors, balancing play, security, legal requirements or new features. Such changes cost you nothing. If a change significantly and adversely affects your access to something you paid for, you have the rights described in section 7.
6. Purchases
If the game offers purchases, they are made through Google Play, whose terms and payment rules also apply. Prices are shown in Google Play before you buy, including taxes.
Right of withdrawal. As a consumer in the EU you normally have 14 days to withdraw from a distance contract. For digital content supplied immediately, such as in-game items, you lose that right once delivery starts, if you have agreed to immediate delivery and acknowledged that you will lose the right. The game asks for both before each purchase.
Refunds are also available under Google Play's refund policies.
7. If something doesn't work (complaints)
We are responsible for the game conforming to these terms, as the consumer-rights law requires.
If the game or something you bought doesn't work as it should, write to contact@peakcloudgameworks.com with a description of the problem, your device model and the game version. We answer every complaint within 14 days. If the problem is ours, we will fix it within a reasonable time. Where the law gives you the right to it, you can ask for a price reduction or a refund, or end the agreement.
If you are a consumer, you can also turn for free help to your local consumer ombudsman (rzecznik konsumentów) or the Trade Inspection (Inspekcja Handlowa), or to a consumer body in your own country.
8. Availability and ending the agreement
You can stop at any time by uninstalling the game.
We work to keep the game running, but it may contain errors, and the online parts (videos, purchases) may sometimes be unavailable. We may stop distributing the game or its online features. If so, we will announce it on our website at least 30 days in advance, and the game on your device will keep working offline. Your statutory rights for anything you paid for are not affected.
We may end your licence if you seriously breach section 4, after asking you to stop where that is possible.
9. Liability
- We are fully liable for damage we cause intentionally or through gross negligence, for personal injury, and wherever the law does not allow liability to be limited.
- The game is free to play. For anything beyond that, we are not liable for slight negligence, except where we breach an essential duty of the agreement, and then only for damage typical and foreseeable for this kind of agreement.
- We are not responsible for the services of third parties that we do not control, such as Google Play, the advertising companies or your network provider.
- Nothing in these terms limits the rights a consumer has under mandatory law. If you are a consumer, sections 5 to 9 apply only so far as that law allows.
10. Changes to these terms
We may change these terms for valid reasons: changes in the law, in the game or its features, or in security. We will publish the new version on our website, with its date, at least 14 days before it applies. If you don't agree, you can stop using the game. If you keep playing after that date, the new terms apply.
11. Law and disputes
Polish law applies. If you are a consumer, you also keep the protection of the mandatory law of the country where you live, and you may bring a dispute before the courts of that country. Other disputes go to the courts competent for our registered office in Katowice.
